1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and ticketyboo.ai LLC ("Company," "we," "us," or "our"), governing your access to and use of the SwingSpeak mobile application and any related services (collectively, the "Services").

By downloading, installing, or using SwingSpeak, you agree to be bound by these Terms. If you do not agree, do not use the Services.

We may update these Terms at any time. Material changes will be communicated via the "Last Updated" date, email, or in-app notice. Continued use after changes constitutes acceptance.

2. Eligibility

SwingSpeak is intended for users aged 13 and older. If you are under 18, you must have parental consent and supervision to use the Services.

By using SwingSpeak, you represent and warrant that:

• The information you provide during registration is accurate and current.
• You have the legal capacity to agree to these Terms.
• You are physically able to participate in golf training and have consulted a medical professional if necessary.
• You will not use the Services for any unlawful purpose.

3. Your Account

You are required to create an account to use SwingSpeak. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

We may suspend or terminate accounts if inaccurate information is provided or if these Terms are violated.

4. Health and Physical Activity

This is the most important section of these Terms.

Before You Start

• Consult your doctor before beginning any speed training or exercise program, especially if you have any health conditions, injuries, or concerns about your physical readiness.
• Know your limits. Speed training involves explosive movements that place stress on your body. If you're new to this type of training, start conservatively.
• Warm up properly before every training session. Cold muscles are more prone to injury.

During Training

• Stop if something hurts. Pain is your body telling you something is wrong. Don't push through it.
• Don't overdo it. More is not always better. Rest days matter. Fatigue leads to poor form, and poor form leads to injury.
• Use proper equipment in good condition. Check your clubs and training aids before each session.
• Practice in a safe environment with adequate clearance around you. Be aware of others nearby.

Speed Training Specifics

If you're using speed training protocols (whether from SwingSpeak or external programs like The Stack System, SuperSpeed Golf, or Rypstick), understand that these involve swinging at maximum effort. This type of training:

• Places significant stress on your muscles, joints, and connective tissue
• Requires proper progression—don't skip steps or rush through programs
• Should be done when you're fresh, not fatigued
• Has specific protocols and safety guidelines—follow them

Your Acknowledgment

By using SwingSpeak, you acknowledge that:

• Physical training carries inherent risk of injury
• You are solely responsible for determining whether you are physically capable of performing any exercise or training program
• You assume full responsibility for any injury or damage that may result from your training
• SwingSpeak provides data, tools, and training templates—not medical advice, physical therapy, or personalized coaching

5. Training Programs

SwingSpeak includes swing tempo and speed training programs developed by ticketyboo.ai LLC. These programs:

• Are designed as general training templates, not personalized coaching
• Do not replace instruction from a qualified golf professional
• Do not constitute medical or physical therapy advice
• Should be adapted to your individual fitness level and capabilities

If you want to improve your technique, work with a qualified instructor. If you have questions about your physical readiness for training, consult appropriate professionals.

6. Measurement Accuracy

SwingSpeak displays data from your Garmin R10 launch monitor. Please understand:

• All measurements are estimates based on radar data and algorithms
• Accuracy depends on proper setup, lighting conditions, calibration, and firmware
• The Garmin R10 is a consumer device, not professional-grade measurement equipment
• Different launch monitors may report different values for the same swing
• We do not guarantee the accuracy of any measurements

Use the data for training purposes and to track trends—don't treat any single number as definitive.

7. User Contributions

You may create content within SwingSpeak, such as custom club configurations, session notes, and other user-generated content ("Contributions").

Ownership: You retain ownership of your Contributions.

License: By creating Contributions, you grant us a worldwide, non-exclusive, royalty-free license to host, display, store, and use them to provide the Services and improve our products.

Anonymized Data: We may use anonymized, aggregated data derived from your Contributions and usage for research, product improvement, developing new features, and training AI models. This data cannot be used to identify you.

8. Prohibited Activities

You may not use SwingSpeak for purposes other than those we make available. Prohibited activities include:

• Unauthorized scraping, extraction, or automated data collection
• Impersonation or misrepresentation
• Circumventing or interfering with security features
• Uploading malware, viruses, or harmful code
• Harassment, abuse, or threats
• Reverse engineering, disassembly, or modification of the app
• Commercial use not expressly authorized by us

9. Purchase and Payment

SwingSpeak is available as a one-time purchase through the Apple App Store. All payments are processed by Apple according to their terms and conditions.

Refunds: Refund requests are handled by Apple according to their policies. We do not process refunds directly.

Updates: Your purchase includes access to future updates to SwingSpeak at no additional cost. We may offer additional apps, features, or products as separate purchases in the future.

10. Your Equipment

You are solely responsible for:

• Your golf clubs and training aids—their condition and appropriate use
• Your Garmin R10—proper setup, maintenance, and use according to Garmin's instructions
• Any damage to your property or others' property during practice
• Ensuring you have safe space and clearance for training

We are not responsible for damage to your equipment, your property, or third-party property.

11. Intellectual Property

SwingSpeak and all source code, software, designs, text, graphics, and other content (collectively, "Content") are owned or licensed by ticketyboo.ai LLC and protected under intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, sell, license, or exploit the Content for commercial purposes without prior written consent.

"Garmin" and "R10" are trademarks of Garmin Ltd. "The Stack System," "SuperSpeed Golf," and "Rypstick" are trademarks of their respective owners. We are not affiliated with these companies.

12. Third-Party Services

SwingSpeak connects to Garmin R10 hardware via Bluetooth. We are not affiliated with, endorsed by, or partnered with Garmin Ltd. Your use of the R10 is subject to Garmin's terms and warranty.

The app is distributed through Apple's App Store, subject to Apple's terms of service.

We do not control, endorse, or assume responsibility for third-party products or services.

Your use of SwingSpeak is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

You agree to defend, indemnify, and hold harmless ticketyboo.ai LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights

17. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

International users may have additional rights under local laws, but by using the Services, you agree to the exclusive jurisdiction of Wyoming courts except where arbitration applies.

18. Dispute Resolution

Most disputes can be resolved informally. You agree to first attempt to resolve any dispute by contacting us at hello@swingspeak.app.

If unresolved after 30 days, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Wyoming.

You waive any right to a jury trial or to participate in a class action.

Certain disputes (e.g., intellectual property infringement, unauthorized use) may be brought directly to court.

19. Termination

You may stop using SwingSpeak at any time by deleting the app and your account.

We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine is harmful to us, other users, or third parties.

20. Electronic Communications

By using SwingSpeak, you consent to receive electronic communications from us.

You agree that agreements, notices, and records provided electronically satisfy any legal requirement for written communication.

21. Miscellaneous

• These Terms constitute the entire agreement between you and us regarding SwingSpeak.
• If any provision is found unenforceable, the remaining provisions remain in effect.
• We may assign our rights and obligations under these Terms.
• Our failure to enforce any right shall not be deemed a waiver.
